Certification of Information. By applying for membership, all applicants attest to the following statement:
“By submitting this form on behalf of my family, I hereby certify that this application is complete and accurate. I have read and understand these Membership Terms and Conditions and also understand the annual renewal requirements. I understand that providing false or misleading information in this application form shall be grounds for denial or termination of membership. I understand that the approval of my application is subject to the discretion of Heritage Defense. I also understand that membership may be suspended or terminated if we violate these Membership Terms and Conditions or otherwise engage in misconduct.”
Statement of Belief. Applicants must be professing Christians and substantially agree with our Statement of Belief:
“We proclaim that we are sinners in the sight of God the Father, justly deserving His wrath and without hope except for His sovereign mercy and grace; that we believe in the Lord Jesus Christ as the Son of God, and God the Son; that He died for our sins, was buried and rose again on the third day; that we have been drawn by the Holy Spirit to trust in the Lord Jesus Christ as Savior, and have willingly identified with Christ. We further proclaim that the Bible is God’s infallible and inerrant Word; that it is the standard by which we will measure our lives and our conduct with one another.”
Home Educators. Currently, membership is open only to families who home educate all of their “school-age” children or have no “school-age” children.
Foster Care System. Because foster care systems have mandates inconsistent with the work of Heritage Defense, applications from current foster parents will not be approved. Existing members must notify Heritage Defense prior to becoming involved with the foster care system.
Activation of Membership. All applications are reviewed to determine eligibility for membership. Membership becomes active when approved by Heritage Defense.
Contribution Processing. If your application is not approved, the contribution for your membership will not be processed.
Monthly Contribution Option. If you select the monthly contribution option, you commit to make twelve (12) monthly contributions for your annual membership. After your initial contribution (which will be processed if and when your membership is approved), all subsequent contributions will be automatically charged to your credit/debit card around the 5th day of each month. If you need to update your credit/debit card information, please contact us. Termination of contributions for any reason will result in immediate suspension of your membership and subsequent termination if not corrected.
No Charitable Deduction. Heritage Defense is a 501(c)(4) nonprofit legal advocacy organization. Contributions to it are not deductible for federal income tax purposes.
Communication. Applicants/members consent to receiving communications from Heritage Defense, including emails. Renewal notices are generally sent by email. It is your responsibility to update your contact information if it changes.
Scope of Legal Representation; Not an Insurance Company. Consistent with Internal Revenue Service regulations, we cannot guarantee representation in every case. However, it is our intent to come to the aid of our members (and non-members in special cases) who suffer governmental social service related interference in the jurisdiction of their families as a result of obedience to Scriptural standards of child training and discipline.
Investigation. When a member contacts Heritage Defense regarding a threatened social services action, Heritage Defense reserves the right to conduct a preliminary investigation prior to initiating legal representation. Heritage Defense reserves the right to decline legal representation if, in its sole and absolute discretion, Heritage Defense believes that actual abuse, neglect, or other misconduct has occurred or is occurring, or that a conflict of interest exists. Membership may be terminated in such a case. Heritage Defense condemns and will not defend child abuse.
Exclusions from Services. In addition to reserving the right to deny membership and decline legal representation in certain cases, Heritage Defense generally does not provide membership services in circumstances including, but not limited to, matters arising from or involving: (1) domestic disputes, divorce, related child custody proceedings, foster care, or adoptions involving government social services agencies; (2) polygamy, civil unions, or non-heterosexual “marriages”; (3) facts occurring prior to the commencement of membership with Heritage Defense; or (4) a situation in which, in the sole judgment of Heritage Defense, a parent is the direct or indirect source of an accusation.
